Introduction
Insuring a motorbike in France is not like insuring a car. The rider is the most exposed person on the road, and French compulsory insurance does not protect the rider who is at fault. Theft clauses are the most demanding in all of motor insurance. New riders pay a surcharge set by a precise legal clause that few people know how to read. And your gear (helmet, gloves, jacket, airbag) is worth a sum most policies only cover as an option. If you come from another country, add two more questions: will your licence and your riding history count in France?
This kit gives you the exact rules and the method, in the order you meet them: licence and vehicle category, price and surcharge, reading the policy, gear, theft, winter and roadworthiness tests, accidents, then worked cases and letters. The rules are those of the French Insurance Code (code des assurances) and Highway Code (code de la route) in force on 23 October 2026. Letters to your insurer must be in French: each template is in French, followed by its English translation.
How to read it: chapter 1 explains what compulsory cover pays and what it leaves to you; chapter 2 licences, including foreign ones; chapter 3 new riders, foreign history and the no-claims bonus; chapter 4 the policy grid; chapter 5 gear; chapter 6 theft; chapter 7 winter, roadworthiness and special uses; chapter 8 accidents; chapter 9 six worked cases; chapter 10 the letters; chapter 11 checklists and glossary.
What compulsory motorbike insurance pays, and what it leaves to you
The principle
Every motorbike, scooter and moped, including a 50 cc scooter that never leaves the garage, must be insured at least for third-party liability (responsabilité civile, Insurance Code art. L211-1). Riding uninsured is a criminal offence. If you cause an accident without insurance, the national guarantee fund (FGAO) pays the victims and then claims everything back from you.
The rule that changes everything for a rider: the law of 5 July 1985
The Badinter law (no. 85-677 of 5 July 1985) governs compensation of road accident victims. It sets two categories:
| Victim | Compensation rule | Text |
|---|---|---|
| Passenger, pedestrian, cyclist (non-driver) | Compensated for personal injury, except for an inexcusable fault that was the sole cause of the accident (even more protective rules for under-16s, over-70s and people with severe disabilities) | Law of 5 July 1985, art. 3 |
| Driver or rider | Their own fault may limit or exclude their compensation | Law of 5 July 1985, art. 4 |
In practice: your pillion passenger is compensated by your liability insurance, even if you are at fault. You, the rider, are not compensated if the accident is your doing, and only partly if a fault is held against you in an accident with someone else. Only an optional rider's personal injury cover (garantie du conducteur or garantie du pilote) pays you then.
The levels of cover in plain English
| French name | What it adds to liability | When it is worth discussing |
|---|---|---|
| Au tiers | Usually only legal defence and recourse | Low-value bike |
| Tiers étendu / vol-incendie | Theft, fire, sometimes natural events | Mid-value bike, exposed to theft |
| Tous risques / dommages tous accidents | Damage to your bike even when you are at fault or the other party is unknown | Newer, financed or leased bike |
| Garantie du pilote | Your own injuries, whatever the level | Every rider |
| Équipement | Helmet, gloves, jacket, airbag damaged in an accident | Valuable gear |
| Assistance | Breakdown, accident, towing, sometimes from home | Daily use, touring |
The three figures to read first
- The ceiling and threshold of rider cover. A permanent disability threshold of 10% or more excludes most injuries; a low ceiling does not cover a serious disability.
- The theft conditions. Required lock, overnight parking, marking: if you cannot meet them, theft cover is useless to you.
- **The excess (franchise) of each cover.**
The question to ask your insurer today
"If I fall on my own tomorrow and am injured, what does my policy pay me, from what disability rate, and up to what limit?" If the answer is "nothing", read chapter 4.
