Introduction
Setting up as self-employed in France brings a question that British, Irish, American and Dutch newcomers find hard to answer: which insurance is actually compulsory? The French system has no single “business insurance” rule. It has a patchwork: a few obligations tied to your situation (vehicle, rented premises), obligations tied to specific trades (health, property, building), and a strong market habit of asking for an attestation d’assurance before any contract. This kit sorts it out, with the official source for each rule, then gives you grids to read French policies and the French letters you will need.
It is written for the micro-entrepreneur regime (formerly auto-entrepreneur), the usual starting point for English speakers, and also works for other sole traders (entrepreneur individuel). The rules are those of the official French business portal entreprendre.service-public.fr (checked on 7 July 2026), the Insurance Code (code des assurances), the Civil Code, the Commercial Code, the Crafts Code (code de l’artisanat) and the Tourism Code, as in force on 21 October 2026.
How to read it: chapter 1 sorts insurance into three piles; chapter 2 lists the regulated trades; chapter 3 covers building work and the décennale; chapter 4 the wording on quotes and invoices; chapter 5 how to read an RC pro; chapter 6 premises, home office and vehicle; chapter 7 gîtes and chambres d’hôtes; chapter 8 your assets and income; chapter 9 switching, cancelling and closing; chapter 10 six case studies; chapter 11 a glossary; chapter 12 the letters; chapter 13 checklists.
What this kit adds to the free pages
English-language pages on French business insurance are mostly brokers’ sales pages, and some state that professional liability is compulsory for everyone, which is not what the official portal says. French official pages are short and in French. This kit links each obligation to its text, explains French policy wording in English, and covers what expat entrepreneurs actually run into: the décennale for builders, gîtes and chambres d’hôtes, a home office, a British-registered or personal car used for work.
Three piles: compulsory, expected, optional
Pile 1: compulsory, depending on your situation
The official page on micro-entrepreneur insurance (entreprendre.service-public.fr, in French) lists these obligations, depending on your situation:
| If… | Then insurance is compulsory | Legal basis |
|---|---|---|
| You carry out a regulated activity that requires it | Professional liability (responsabilité civile professionnelle, RC pro) | The text of each profession (chapter 2) |
| You work in construction | Ten-year liability (responsabilité décennale) | Insurance Code, art. L241-1 (chapter 3) |
| You are a health professional | Medical liability | Public Health Code, art. L1142-2 |
| You own or rent a vehicle used for the business | Insurance for each vehicle | Insurance Code, art. L211-1 |
| You rent your work premises | Insurance of the premises | Official page; your lease will require it too |
| You employ staff | Complementary social protection for employees | Official page (outside this kit) |
Pile 2: not compulsory, but expected
- RC pro outside regulated trades: French business clients, platforms and landlords routinely ask for an attestation before signing.
- Insurance for your equipment and stock: your home policy usually does not cover business property.
- Declaring a home-based business to your home insurer (chapter 6).
Pile 3: your call
- Legal expenses cover (protection juridique)
- Business interruption (perte d’exploitation)
- Income protection (prévoyance)
- Cyber insurance if you hold client data or sell online
Your ten-minute diagnosis
| Question | Yes / no | If yes |
|---|---|---|
| Is my activity in the regulated list of chapter 2? | RC pro compulsory: contact the professional body | |
| Do I build, renovate or alter a building (structure, roof, damp-proofing, fixed installations)? | Décennale compulsory before the first job | |
| Do my clients or platforms ask for an attestation? | RC pro compulsory in practice | |
| Do I work in clients’ homes, on their equipment or data? | RC pro including financial loss (immatériels) | |
| Do I receive the public at home or in premises? | Operating liability; tell the insurer of the premises | |
| Do I use a vehicle for the business? | Business use declared | |
| Do I host paying guests? | Chapter 7 | |
| Do I own valuable tools, equipment or stock? | Business property cover | |
| Would a few weeks off work hurt my finances? | Income protection (chapter 8) |
