Introduction
Under French law n° 2022-270 of 28 February 2022, known as the Lemoine law, the borrower insurance attached to a French home loan can be cancelled at any time, with no anniversary date and no fees. This kit shows you how to work out the real saving, get a policy that meets your bank’s criteria and send the right letters, in French and in the right order, without ever being left uncovered for a day.
The kit is up to date as of 1 October 2026. The articles quoted were checked in their current version on Légifrance, the official French legal database; always check the consolidated version before sending a letter. French terms are given in italics so you can recognise them in your own documents.
What the Lemoine law lets you do in 2026
Five rights to know
1. Cancel at any time. Article L113-12-2 of the Insurance Code (code des assurances) lets the insured person cancel their borrower insurance (assurance emprunteur) "at any time from the signature of the loan offer". For a policy from a mutual insurer, the equivalent right is in article L221-10 of the Mutual Insurance Code (code de la mutualité). The right belongs exclusively to the insured person.
2. Judged only on equivalent cover. The lender may not refuse another policy that offers a level of cover equivalent to its own (équivalence du niveau de garantie, article L313-30 of the Consumer Code, code de la consommation). Any refusal must be explicit and give all the reasons, stating where relevant the missing information or guarantees. Price or the adviser’s preference are not grounds.
3. An answer within 10 working days. The lender notifies its decision within ten working days (dix jours ouvrés) of receiving the other policy; if it accepts, it amends the loan contract (avenant) within the same period, stating the new APR (TAEG) (article L313-31 of the Consumer Code).
4. No fees, no change to your interest rate. No fee may be charged for the amendment (article L313-31). Nor may the lender change the interest rate or loan conditions, or charge for analysing the competing policy (article L313-32).
5. No health questionnaire, under conditions. If the insured share is €200,000 or less per insured person and the loan ends before age 60, the insurer may not ask any health question (article L113-2-1 of the Insurance Code, see chapter 5).
Also: the insurer must remind you yearly of your right to cancel (article L113-15-3 of the Insurance Code), and cannot cancel your policy for increased risk, save decree-defined cases of voluntary change in behaviour (article L113-12-2).
Which loans are covered
The right covers insurance on a loan referred to in point 1° of article L313-1 of the Consumer Code: in practice, a French consumer-law loan financing the purchase of a home or of mixed residential and professional premises. For any other loan, including a mortgage from a foreign lender under foreign law, check the scope on Légifrance first. The rules apply to loan offers issued since 1 June 2022 and, since 1 September 2022, to all policies then in force: a loan signed in 2012 is covered just like one signed last month.
The three-minute test

- Has the insurance cost been identical every month since the start (a sign it is calculated on the initial loan amount)?
- Are there several years of repayments left?
- Has your situation improved since you signed (stopped smoking, end of a treatment, less exposed job)?
- Is your insured share of the outstanding balance now under €200,000, with the loan ending before you turn 60?
